Version effective as of August 16, 2026
These General Terms and Conditions of Use and Sale (hereinafter the “Terms”) govern access to the website www.djobi.fr , the use of the features offered, and sales made through DJOBI.
They are drafted in such a way as to distinguish between the rules applicable to all users, those applicable to consumers, and those applicable to business customers. The mandatory provisions of consumer law take precedence over any provision to the contrary.

3. Purpose, Scope, and Enforceability
These Terms and Conditions govern the use of the Site and contracts entered into remotely with DJOBI. They apply subject to any specific terms clearly presented prior to placing an Order for certain offers, including payment upon delivery, hosting, business offers, personalized products, subscriptions, commercial warranties, or services provided on a quoted basis.
Before confirming an Order, the Customer may view, download, or print the Terms and Conditions. Checking the box provided for this purpose constitutes acceptance of the Terms and Conditions. The terms and conditions applicable to an Order are those accepted on the date the Order is placed and are included or accessible in a durable medium in the order confirmation.
The headings are provided for convenience only. The invalidity of any provision shall not affect the validity of the other provisions. DJOBI’s failure to invoke a provision on a particular occasion shall not constitute a waiver of its right to rely on that provision at a later time.
Photographs, videos, renderings, and product scenarios illustrate the Products. They do not replace the written essential characteristics. Differences due to the screen, lighting, minor changes in presentation, or packaging—which do not affect either the essential characteristics or the intended use—do not, in and of themselves, constitute a lack of conformity.
4. Site Access and Availability
The Site is normally accessible without interruption, subject to maintenance, updates, technical incidents, security measures, network failures, or events beyond DJOBI's reasonable control.
DJOBI may update the interface or temporarily suspend a feature in order to maintain security, correct a defect, or ensure service continuity. These actions do not affect the rights acquired under an Order and do not deprive the Consumer of the remedies available to them under the law.
The User must have a device, up-to-date web browser software, and Internet access. It is the User’s responsibility to take standard security precautions. Any attempt at unauthorized access, tampering, mass data extraction, circumvention of security measures, intentional overloading, or abusive automated use is prohibited.
5. Customer Account, Authentication, and Security
5.1 Creation and Accuracy of Information
Creating an Account is free. The Customer must provide accurate, complete, and up-to-date information. The Customer must not impersonate a third party or create an Account for fraudulent purposes. A minor may place an order only with the authorization and under the responsibility of his or her legal guardian, within the limits provided by law.
5.2 Credentials and Strong Authentication
Login credentials are personal and confidential. The Customer must choose a strong password, not reuse it on other services, and not share it with anyone. When two-factor authentication is offered or required, the Customer is advised to enable it and keep their recovery credentials in a safe place.
Temporary codes, login links, and backup codes must never be shared with a third party, including anyone claiming to be a support representative. DJOBI never asks for the Customer’s full password.
5.3 Security Incident
If unauthorized access is suspected, the Customer must immediately change their password, revoke any sessions they do not recognize (when this feature is available), and contact DJOBI. DJOBI may require a password reset, terminate a session, or temporarily suspend the Account when a proportionate measure is necessary to protect the Customer, the Site, or third parties.
5.4 Suspension and Closure
DJOBI may suspend an Account if there are serious indications of fraud, identity theft, a security breach, obvious abuse, or a serious violation of the Terms. Unless there is an emergency or a legal prohibition, the Customer will be notified of the reason and will be given a reasonable opportunity to rectify the situation or contest the decision.
Closing an account does not delete invoices, warranties, orders, evidence, dispute records, or data that must be retained pursuant to a legal obligation. It does not extinguish any amounts due or rights that have already accrued.
6. Community Features and User-Generated Content
The Site may allow the Customer to create wish lists, save preferences, post a review, ask a question, open a support ticket, report an issue, or submit information relevant to a request.
The User remains responsible for their content. They warrant that it is accurate, relevant, and lawful, and that they hold the necessary rights. In particular, the following types of content are prohibited: defamatory, offensive, discriminatory, violent, misleading, promotional, infringing, invasive of privacy, containing unnecessary sensitive data, malicious software, or fraudulent links.
DJOBI may moderate, hide, or remove content that is clearly illegal, off-topic, fraudulent, or in violation of the Terms, and may retain any information necessary to substantiate or address a report. Moderation does not constitute a general prior review of all content.
6.1 Online Reviews
When a review is published, the Site indicates, either near the product or in a dedicated notice, the procedures for collecting, verifying, categorizing, and publishing the review; the date of the relevant experience, when available; and whether there was any compensation involved. DJOBI does not present a review as coming from a verified buyer without first conducting a reasonable verification process to confirm this.
A negative review cannot be rejected on that ground alone. However, it may be removed if it does not comply with the posting rules, if it concerns a different product, or if it contains illegal content. The author grants DJOBI, free of charge and for the applicable term of protection, a non-exclusive license strictly necessary for the hosting, reproduction, translation, formatting, and display of the review on DJOBI’s platforms.
6.2 Wish Lists and Alerts
Wish lists, favorites, availability alerts, and price alerts do not constitute a reservation, a guarantee of availability, or a commitment to maintain the price. The items listed may become unavailable or be removed from the catalog.
7. Products, Services, and Pre-Contractual Information
Prior to placing an order, DJOBI provides information on the essential features, price, applicable fees, known availability, delivery or fulfillment date or timeframe, geographic restrictions, payment terms, warranties, contract term, and termination conditions, where applicable.
The Customer must read the product specifications and verify the product’s compatibility with their equipment, environment, and intended use. Automated recommendations, comparisons, suggestions, compatibility lists, and sales responses are intended to assist in decision-making; the specifications confirmed in the product specifications, the quote, or a specific written communication take precedence.
For spare parts, components, consumables, and accessories, the Customer must verify the part numbers, dimensions, connectors, versions, models, and prerequisites. Any license or territorial restrictions applicable to digital content are specified in the offer.
Used or refurbished products are identified as such. Their cosmetic condition, any missing accessories, their known remaining capacity, and the tests performed are described as applicable. An imperfection expressly brought to the Customer’s attention prior to the sale may not be claimed as a defect on that basis alone.
8. Order and Formation of the Contract
The Customer selects the Products or Services and any available options.
He checks the shopping cart, quantities, product variations, addresses, delivery methods, and payment options.
The customer reviews the total price and the Terms and Conditions, and can then correct any errors.
He expressly confirms an order that includes a payment obligation.
DJOBI acknowledges receipt electronically.
The automatic confirmation acknowledges receipt of the Order. The contract is concluded subject to acceptance of payment, availability, and the absence of any obvious irregularities or fraud. For services provided on a quoted basis, the contract is formed upon acceptance of the quote within its validity period and, if applicable, payment of the required deposit.
DJOBI may refuse an Order for a legitimate reason, including unavailability, an obvious pricing error, an abnormal quantity, inability to deliver, a prior unpaid balance, serious suspicion of fraud, an applicable economic sanction, or a request for unauthorized customization. The Customer will be notified of this, and any amount collected for the rejected Order will be refunded.
A clear pricing error—one that a reasonably attentive consumer could not have reasonably overlooked—does not obligate DJOBI to deliver the item at the incorrect price. In such cases, an alternative solution or a cancellation at no charge will be offered.
9. Prices, Promotions, and Fees
The prices offered to consumers are listed in euros, including all taxes, excluding any additional fees that are clearly disclosed before confirmation. The total amount due, including taxes, shipping, and selected options, appears in the order summary.
Prices are subject to change at any time for future orders. A subsequent change does not affect an Order that has already been placed, unless the Customer agrees to it or the change corrects an obvious error.
9.1 Price Reductions
When a sale announcement is subject to the prior price rule, the reference price is the lowest price charged by DJOBI to all consumers during the thirty days preceding the application of the discount. In the event of successive discounts during the same promotional campaign, the prior price may be the price charged before the first discount, in accordance with regulations.
A manufacturer's suggested retail price, a comparison price, a new price, or a price listed by a third party is identified as such and is not presented as a previous price charged by DJOBI.
9.2 Codes and Benefits
Promotional codes are personal when designated as such, subject to their validity period and terms and conditions, non-redeemable for cash, and cannot be combined with other offers unless otherwise specified. Any fraudulent use may result in the cancellation of the benefit, without affecting the Customer’s legal rights.
10. Payment, Audits, and Billing
10.1 Payment Methods
The payment methods that are actually available are those displayed at the time of the Order. Their availability may depend on the country, the amount, the Product, the risk profile, or the specific terms and conditions of the payment provider.
The payment is processed according to the chosen method and the information displayed before confirmation. In the case of installment payments, deferred payments, direct debit, or payments due on a specific date, the specific terms and conditions, the payment schedule, the total cost, the consequences of late payment, and the identity of the lender are disclosed before the customer commits to the transaction.
10.2 Payment in installments or deferred payment with Alma
When this option is offered at the time of the Order, the Customer may request to pay in installments or at a later date using the Alma payment solution. The available payment terms, the number and amount of installments, their due dates, the total cost of financing, and any applicable fees are presented to the Customer before the payment is confirmed.
Use of the Alma solution is subject to the Order’s eligibility and Alma’s approval of the application. Alma retains sole discretion to approve or deny requests for financing or installment payments based on its own criteria. By choosing this payment method, the Customer agrees to the Alma's General Terms and Conditions of Payment that are presented to him before he is hired.
DJOBI remains the Client’s point of contact for order fulfillment, delivery, compliance, warranties, cancellations, and returns. Alma remains the Customer’s point of contact for managing financing, payment schedules, direct debits, and payment issues related to its solution. In the event of a cancellation or refund accepted by DJOBI, any resulting changes to the payment schedule are handled in accordance with the terms applicable to the Alma transaction.
10.3 Payment upon maturity (for business customers only)
Regardless of the Alma solution, DJOBI may, on an exceptional basis, grant certain business customers a payment term of thirty, forty-five, or sixty days upon receipt of an invoice. This option is not available to consumers and does not constitute a right, a permanent offer, or an acquired benefit for future orders.
The agreement may be limited to a specific Order or granted for a defined period. DJOBI may modify, suspend, or revoke the agreement for future Orders, particularly in the event of a delay, a payment issue, exceeding the authorized credit limit, inaccurate information, or an adverse change in risk. Such a decision does not retroactively alter the due date of an invoice that has already been issued, unless otherwise agreed by the parties or required by law.
The agreed-upon payment term is specified in the estimate, purchase order, confirmation, or invoice and may not exceed the limits set by law. Unless otherwise agreed upon and accepted by DJOBI, the Order remains payable in full using the payment methods offered at the time of its confirmation.
10.4 Transaction Controls and Security
DJOBI and its service providers may conduct reasonable checks to prevent fraud and ensure the security of transactions. They may request enhanced authentication or documentation that is strictly necessary. If the issue is not resolved within the specified time frame, the Order may be suspended or canceled.
The Customer warrants that he or she is authorized to use the payment method. An unjustified chargeback does not replace the proper exercise of a right of withdrawal, a warranty claim, or a complaint. It may result in the collection of amounts lawfully owed, without prejudice to the Consumer’s rights.
10.5 Billing
Invoices are provided electronically through the Account or by email. The Customer agrees to this format and may request a copy. Invoices are retained in accordance with accounting requirements.
11. Availability and Cancellation
Stock levels are updated regularly but may, in rare cases, differ from actual stock levels, particularly in the event of simultaneous orders, synchronization errors, loss, or defects detected before shipment.
If an item is unavailable after an Order has been placed, DJOBI will notify the Customer as soon as possible. No replacement will be imposed. The Customer may accept an equivalent alternative offered or request cancellation and a refund of the applicable amounts in accordance with statutory deadlines.
12. Delivery, Transfer of Risk, and Acceptance
12.1 Delivery Areas, Methods, and Terms
Delivery is available only in the areas, via the methods, and through the carriers displayed to the Customer during the Order process. The available options may vary depending on the destination, nature, weight, volume, value, or specific constraints of the Product. The terms and conditions actually selected and confirmed in the Order take precedence over any general information.
12.2 Shipping Costs and Free Shipping
Any applicable shipping charges are calculated based on the Order details, the selected shipping method, and the destination. The amount of these charges is disclosed to the Customer before the Order is confirmed and is included in the total price due.
For Customers who do not have the DJOBI+ Package, shipping is free as long as the total amount of the Products in the Order is 80 euros or more, including all taxes, after discounts have been applied and excluding additional fees.
12.3 Delivery Date or Timeframe
The date or deadline provided to the Customer prior to the Order is binding. Unless otherwise specified, DJOBI will deliver or perform the service without undue delay and no later than thirty days after the contract is concluded, unless otherwise agreed or as provided by law.
When multiple Products are ordered together, they may be shipped separately without additional shipping charges, unless the Customer agrees otherwise. The tracking information provided for each shipment allows the Customer to monitor its progress.
12.4 Responsibility for Delivery and Transfer of Risk
When the carrier is recommended or selected by DJOBI, DJOBI remains liable to the Consumer for the proper performance of the delivery, without prejudice to its rights to seek redress from the carrier. The Consumer is not required to resolve any issues with the carrier on their own and may contact DJOBI directly.
For a Consumer, the risk of loss or damage is transferred at the moment the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the goods. The mere notation “delivered” on a shipping tracking record does not deprive the Consumer of the right to dispute receipt. In the event of a dispute, DJOBI will review the available evidence and bears the burden of proving that the goods were actually delivered in accordance with the law.
If the Consumer, on their own initiative, arranges for delivery through a carrier other than the one offered by DJOBI, the risk is transferred upon delivery of the goods to that carrier.
12.5 Delivery, Damaged Packages, and Nonconformities
Upon receipt, the Customer is asked to inspect the apparent condition of the package and the Products. If there is visible damage, a missing Product, or an error, they may refuse the package or note specific reservations on the delivery document, and then notify DJOBI as soon as possible, attaching, where applicable, photographs of the package, the label, and the Product.
These inspections and reservations facilitate the processing of the claim and the pursuit of remedies against the carrier. Their absence, as well as the expiration of a commercial reporting deadline, does not eliminate or reduce the Consumer’s mandatory rights, in particular the statutory warranty of conformity. No 48-hour deadline may be invoked against the consumer to deprive them of a legal remedy.
If the Product is damaged, incomplete, or non-compliant, the Customer should contact DJOBI so that the matter can be handled in accordance with the statutory warranties and applicable provisions. The Consumer is not responsible for any costs incurred to bring a Product into compliance under the statutory warranty.
12.6 Package Marked as Delivered but Not Received
If the tracking information indicates that the package has been delivered but the Customer disputes having received it, the Customer must notify DJOBI as soon as possible and provide the information reasonably necessary for verification. DJOBI will initiate or pursue the necessary steps with the carrier and remains the Consumer’s contractual point of contact when the carrier was selected by DJOBI. Proof of tracking alone is not sufficient, under any circumstances, to dismiss a valid dispute.
12.7 Absence, Failure to Withdraw, and Resubmission
In the event of an absence, the procedures for a redelivery, drop-off at a pickup location, or availability of the package depend on the selected delivery service and the information provided by the carrier. DJOBI does not guarantee a second delivery attempt if it is not included in the selected delivery option.
If the Customer fails to pick up a package within the specified time frame or prevents its delivery due to a circumstance attributable to the Customer, the Product may be returned to DJOBI. The Customer may be required to pay the actual, necessary, and justified costs of a return or reshipment after being notified. This situation does not automatically constitute an exercise of the right of withdrawal and does not deprive the Consumer of the rights granted to them by law.
13. Consumers' Right of Withdrawal
13.1 Principle and Time Limit
The Consumer has fourteen calendar days to cancel the contract without having to provide a reason. For a good, the period begins on the date of receipt by the Consumer or the designated third party. For multiple goods delivered separately, it begins on the date of receipt of the last good, batch, or item. For a Service or digital content not provided on a tangible medium, it begins on the date the contract is concluded.
13.2 Exercise
Before the deadline expires, the Consumer must submit an unambiguous statement expressing their intention to withdraw, using the form provided at the end of this document, through the contact portal, or by email to contact@djobi.fr . He retains proof of shipment. Simply refusing the package or returning it without providing a statement is not sufficient.
13.3 Return of Goods
The Consumer must return the item no later than fourteen days after notifying DJOBI of their decision, to the return address confirmed by customer service. Unless DJOBI agrees to cover the costs or arranges for pickup, the Consumer is responsible for the direct return shipping costs. For an item that cannot normally be returned by mail, an estimate of the cost is provided before the Order is placed or upon request, based on the available information.
The Consumer may handle the item to the extent necessary to determine its nature, characteristics, and proper functioning, just as they would reasonably do in a store. The Consumer may be held liable for any depreciation resulting from handling that exceeds what is necessary. Opening the packaging does not automatically void the right of withdrawal, unless otherwise provided by applicable law.
13.4 Refund
DJOBI will refund payments received, including standard shipping costs, no later than fourteen days after being notified of the decision. Additional costs resulting from the choice of a delivery method more expensive than the standard method are not refunded. For the sale of goods, DJOBI may delay the refund until the goods are returned or proof of shipment is received, whichever comes first.
Refunds are issued via the same payment method, unless another method is expressly agreed upon at no additional cost.
13.5 Services Begun Before the Deadline
If the Consumer expressly requests that performance of a Service begin before the end of the period, the Consumer remains free to withdraw as long as the Service has not been fully performed, but may be required to pay an amount proportional to what has been provided up to the time of the decision. When the Service has been fully performed before the end of the withdrawal period, the right to withdraw is lost only if the legal conditions are met, including an express request and prior acknowledgment of the loss of the right.
13.6 Exceptions
The right of withdrawal does not apply in the cases provided for by law, including:
goods made to the Consumer's specifications or clearly personalized;
goods that are likely to deteriorate or expire quickly;
unsealed goods that cannot be returned for reasons of hygiene or health protection;
audio or video recordings or software that has been unsealed after delivery;
digital content without a physical medium, the performance of which began after express consent, a request for performance, and acknowledgment of the loss of the right, with contractual confirmation;
Services fully performed before the deadline in accordance with legal requirements;
goods that, after delivery and by their very nature, are inseparably mixed with other items.
An exception never precludes statutory warranties in the event of lack of conformity, latent defects, damage, or nonperformance.
14. Commercial Returns and Exchanges
DJOBI may offer a return period that is longer than the legally required period, particularly for certain members or certain offers. The terms and conditions displayed at the time of purchase specify the eligible Products, the return period, the required condition, and who is responsible for the costs.
A commercial benefit is in addition to legal rights and does not replace them. When a return is not covered by the right of withdrawal, a warranty, or an applicable promotional offer, DJOBI may refuse to provide an exchange or refund.
15. Legal and Commercial Warranties
15.1 Statutory Warranty of Conformity
The Consumer is covered by the statutory warranty of conformity provided for in the Consumer Code for goods, digital content, and digital services. The Consumer has two years from the date of delivery of the goods to take action. For goods that include digital elements provided on an ongoing basis for more than two years, the warranty applies for the duration of the scheduled provision period.
The Consumer may request that the product be brought into compliance through repair or replacement, subject to the conditions regarding cost and feasibility provided for by law. The remedy shall be provided free of charge, without significant inconvenience, and within a reasonable time not exceeding thirty days after the request. In the cases provided for by law, the Consumer may obtain a price reduction or rescission of the contract.
Any item repaired under the statutory warranty is covered by a six-month extension of that warranty. If the customer chooses to have the item replaced instead of having the requested repair performed, a new statutory warranty period begins on the date of replacement, in accordance with the law.
Defects that appear within twenty-four months of the delivery of a new item are presumed to have existed at the time of delivery, unless proven otherwise or unless such a presumption is inconsistent with the nature of the item or the defect. For used or refurbished goods, this presumption applies for twelve months. These rules do not shorten the two-year statute of limitations.
15.2 Warranty Against Hidden Defects
The Customer may also invoke the warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code. The Customer may choose between rescission of the sale or a price reduction, provided that the Customer can demonstrate that the defect was hidden, existed at the time of purchase, and renders the goods unfit for their intended use or significantly impairs their use. The action must be brought within two years of the discovery of the defect, subject to statutory limitations.
15.3 Implementation
To request service, the Customer should contact customer service, describe the defect, and provide proof of purchase along with any other relevant information. DJOBI may not make the exercise of a statutory warranty contingent upon registering a commercial warranty, retaining the original packaging, or contacting the manufacturer in advance.
Before returning any device containing data, the Customer should, if possible, back up the data and delete their personal information. A service call may result in data loss when such action is necessary for diagnosis or repair; the Customer will be notified of this whenever possible. DJOBI must never receive the Customer’s personal passwords.
15.4 Legitimate Exclusions
The warranties do not cover a defect of which the Customer was specifically aware and which the Customer separately accepted at the time of purchase, nor do they cover damage caused after delivery due to accident, improper use, unauthorized modification, lack of maintenance, or external incompatibility unrelated to the Product. However, it is DJOBI’s responsibility to apply the rules of evidence provided for by law.
15.5 Commercial Warranties
A commercial warranty, extended warranty, or “lifetime warranty” applies only to Products expressly indicated as eligible and in accordance with the terms and conditions provided in a durable medium. These terms and conditions specify the warranty’s duration, geographic coverage, any applicable price, scope, procedure, exclusions, and the identity of the warrantor. It is provided in addition to statutory warranties, either free of charge or for a fee, without reducing the scope of those warranties.
When registration within a specified time frame is required for a commercial warranty, this requirement never affects statutory warranties.
16. Digital Content and Services
The specific terms and conditions for software, a license, a download, or a digital service specify compatibility, interoperability, technical restrictions, the duration of access, the number of devices, the geographic scope, and any required updates.
The Customer shall comply with the license terms and shall not circumvent any protection measures. Unless authorized to do so, the Customer shall not resell, share, reproduce, or make available any license key or content.
DJOBI provides the updates necessary to maintain compliance during the applicable period and notifies the Customer when they are available. The Customer must install them within a reasonable time. DJOBI is not liable for any defect resulting solely from a failure to install the updates when the required information and instructions have been properly provided to the Customer.
For immediate delivery before the end of the withdrawal period, DJOBI obtains—when required by law—the Consumer’s express request, their consent at the outset, and their acknowledgment that they have forfeited their right of withdrawal.
17. Customized Products and Tailored Services
Before finalizing the order, the Customer must verify the spelling, dimensions, part numbers, files, images, configurations, and instructions provided. The Customer warrants that it holds the necessary rights to the items provided and that they are not illegal.
DJOBI may refuse a customization that violates the law, the rights of third parties, public order, or public decency. When the Product is made to the Consumer’s specifications or is significantly customized, the right of withdrawal may be excluded. This exclusion is noted prior to the Order.
The exclusion of the right of withdrawal does not authorize DJOBI to deliver a Product that differs from the approved specifications, nor does it preclude statutory warranties.
18. Subscriptions and the DJOBI+ Package
18.1 Content of the Offer
The content, price, duration, geographic coverage, restrictions, any trial period, and benefits of the DJOBI+ Pack or any subscription are as displayed prior to subscription. Throughout the validity period of the DJOBI+ Pack, the subscriber is entitled to free shipping regardless of the Order amount, subject to the conditions specified in Section 12.2.
18.2 Renewal
When a subscription is automatically renewed, the Customer is notified before the renewal takes effect. DJOBI notifies the Consumer in writing, within the timeframes required by law, of the option not to renew the contract. Termination can be easily completed online when required by law.
18.3 Trial Period and Right of Withdrawal
A commercial trial period does not replace the legal right of withdrawal. If the Consumer requests immediate use of benefits before the end of the trial period, the consequences regarding any amount that may be due are explained to the Consumer in accordance with the law. A clause excluding any refund solely because a benefit has been used cannot deprive the Consumer of their mandatory rights.
18.4 Termination of the Subscription
Cancellation terminates future renewals. Unless otherwise provided by law or in the terms of service, benefits remain available until the end of the paid term. DJOBI may suspend a subscription in the event of nonpayment, fraud, or serious abuse, after providing notice and an opportunity to resolve the issue when circumstances permit.
19. Customer Service, Complaints, and Reports
Customer service handles inquiries regarding orders, deliveries, invoices, returns, warranties, subscriptions, and accounts. Correspondence can be consolidated into a secure ticket and made available in the account.
The Customer should avoid submitting multiple tickets for the same issue and should provide all relevant information. No internal quota may prevent a Consumer from exercising a legal right or filing a complaint.
The “Report a Problem with This Product” feature is intended to notify DJOBI of errors in the product description, images, compatibility, or listing. It does not replace a complaint, warranty claim, return, or cancellation. The lack of an individual response to a simple report does not preclude the use of other customer service channels.
20. Liability
DJOBI is liable for the proper performance of the obligations arising from the contract under the conditions provided by law. No provision limits liability in the event of bodily injury, gross negligence or fraud, a violation of a mandatory legal right, lack of conformity, or any other circumstance in which a limitation is prohibited.
DJOBI is not liable for any damage resulting exclusively from the Customer’s fault, from an unforeseeable and insurmountable act by a third party not party to the contract, or from a force majeure event. It is not liable for any incompatibility clearly indicated prior to the Order or for any use contrary to the instructions.
Links to third-party websites are provided for informational purposes only. DJOBI does not necessarily control their content or practices. Payment, delivery, or financing services provided directly by a third party may be subject to that third party’s terms and conditions, without this affecting DJOBI’s own obligations as a seller.
For a Business Customer, unless otherwise required by law, compensation for direct damages attributable to DJOBI is limited to the amount (excluding tax) paid for the Order that gave rise to the damages. Indirect damages, such as loss of revenue, loss of customers, loss of unsaved data, or loss of profits, are excluded. This limitation does not apply to Consumers.
21. Intellectual Property
The structure of the Site, as well as the text, databases, trademarks, graphics, photographs, videos, software, and other elements, are protected by the intellectual property rights of DJOBI or their respective owners.
Access to the Site confers only a personal, non-exclusive, revocable, and non-transferable right to view the Site for authorized purposes. Any reproduction, substantial extraction, adaptation, republication, commercial exploitation, or use of a distinctive symbol without authorization is prohibited, subject to legal exceptions.
22. Personal Information
22.1 Responsibility and Principles
DJOBI is responsible for the data processing activities it determines in connection with the Website and sales. It processes data in a lawful, fair, transparent, proportionate, and secure manner. This section provides a summary of the information; a detailed privacy policy, accessible from the footer, supplements this information.
22.2 Data Categories

22.4 Recipients
DJOBI does not sell its customers’ personal data. Data may only be shared with a partner for the partner’s own marketing purposes if there is a valid legal basis and clear disclosure.
22.5 Transfers Outside the European Economic Area
When a service provider processes data outside the European Economic Area, DJOBI verifies the existence of a recognized transfer mechanism, such as an adequacy decision or standard contractual clauses, and implements appropriate additional safeguards when necessary.
22.6 Durations
Data is retained for only as long as is strictly necessary for each purpose, and is then archived or deleted. In general:
Order and billing data: for the duration of the business relationship, followed by archiving in accordance with accounting requirements—generally ten years for accounting records;
Active account: while in use; an account that remains inactive for an extended period may be subject to alerts, deactivation, or archiving, subject to digital purchases and retention requirements;
Tickets and claims: processing time, followed by the time required to gather evidence and the applicable statutes of limitations;
Customer prospecting data: during the customer relationship and, in principle, for three years following its termination or the last relevant contact;
Prospect data: generally three years from the date of collection or the prospect’s last contact;
opt-out list: minimum data retained for at least three years to ensure compliance with the user’s choice;
security logs: retention period commensurate with the risk, investigative needs, and regulatory requirements;
Commercial warranty information: for the duration of the warranty and for the time necessary to handle claims.
22.7 Rights
Under applicable law, every individual has the right to access, rectify, erase, restrict, object to, and request the portability of their data, as well as the right to withdraw consent. They may also provide instructions regarding the handling of their data after their death and file a complaint with the CNIL.
A request may be sent to dpo@djobi.fr or at the corporate headquarters. DJOBI may request proof of identity only if there is reasonable doubt regarding the individual’s identity, and must redact any unnecessary information.
22.8 Security and Violations
23. Cookies and Other Trackers
The Site uses cookies, local storage, pixels, identifiers, and similar technologies. Acceptance of these Terms does not constitute consent to optional trackers.
23.1 Required Tracers
Some cookies are strictly necessary for providing the requested service or for security purposes: maintaining the shopping cart, session management, login, load balancing, language selection, saving privacy preferences, payment processing, fraud prevention, and protection against attacks. They cannot be disabled via the browser settings when they are essential, but remain subject to the principles of data minimization and limited retention periods.
23.2 Optional Tracers
With the required consent, other trackers may measure audience and performance, personalize the experience, compile statistics, evaluate campaigns, provide recommendations, or display ads from DJOBI or its partners.
No optional trackers are set or read until valid consent is given. Opting out must be as easy as opting in. You can opt out at any time from the page Cookies and Privacy , without affecting the validity of prior transactions.
23.3 Durations and Detailed List
The cookie manager must specify, for each category or partner, the purpose, the data controller, the retention period, and, where applicable, any transfer outside the European Economic Area. Consent and opt-out choices are retained for a reasonable period of time; a period of six months is generally considered best practice before a new request is made, unless there is a substantial change or special circumstances.
Certain audience measurement trackers may be exempt from the consent requirement only if they meet all applicable conditions, including a strictly limited purpose, no improper cross-referencing, a restricted scope, and appropriate time limits.
24. Communications and Business Preferences
Messages necessary for managing an Account or an Order—such as confirmations, security notifications, payment notifications, delivery notifications, product recalls, warranty information, or responses from customer support—are not promotional communications and may be sent without marketing consent.
Offers sent by email or text message are sent with the customer’s consent when required. An exception may allow us to present a customer with products or services similar to those already purchased, provided that the customer has been informed and can opt out free of charge at the time of data collection and in each message.
Preferences can be changed on the page My preferences or by using the unsubscribe link. Withdrawing consent for marketing communications does not affect essential service messages.
Tracking whether an email has been opened or how it has been interacted with—when based on a tracker that requires consent—is enabled only after valid consent has been obtained. Advertising preferences associated with the Account and cookie preferences remain separate choices when they relate to different operations.
25. Evidence, Archiving, and Electronic Communications
Computer records stored under reasonable security measures, confirmations, transaction logs, tickets, emails, and authentication credentials may serve as evidence of communications and transactions, subject to each party’s right to challenge their validity.
For any Order that meets the legal threshold, DJOBI archives the contract for the required period and ensures that the Customer can access it upon request. The Terms and Conditions and important confirmations are provided on a durable medium.
The Customer shall ensure that they maintain a valid email address and check their spam folder. A notification is deemed to have been received when it is made available at the address provided, unless there is evidence of an incident or a mandatory provision to the contrary.
26. Changes to the Terms and Conditions
DJOBI may amend the Terms in the future to reflect legal, functional, commercial, or security changes. The new version will indicate its effective date.
Changes do not apply retroactively to a one-time Order that has already been placed. For an ongoing contract or subscription, the Customer will be notified in a durable medium within a reasonable time if the change affects their rights or obligations. The Customer may terminate the contract without penalty when permitted by law.
27. Force majeure
Neither party shall be liable for a breach caused by a force majeure event as defined in Article 1218 of the Civil Code. The party prevented from performing shall notify the other party as soon as possible and take steps to minimize the consequences. If the impediment is temporary, the obligation is suspended; if it is permanent or if the delay justifies termination, the contract may be terminated in accordance with the law.
28. Governing Law, Mediation, and Disputes
28.1 Prior Notice of Claim
These Terms and Conditions are governed by French law. The Consumer retains the mandatory protections provided by the law of the country in which he or she habitually resides, to the extent that such protections are granted by law.
Before any mediation, the Customer must submit a written complaint to customer service, explaining the problem and the desired solution. DJOBI and the Customer will endeavor to reach an amicable resolution.
28.2 Consumer Mediation
If a prior written complaint has not been resolved satisfactorily, the consumer may, free of charge and within the statutory time limit, file a complaint with the consumer ombudsman responsible for DJOBI:
Association of European Mediators — AME CONSO
Website: www.mediationconso-ame.com
Mailing Address: 197 Boulevard Saint-Germain, 75007 Paris, France
The admissibility of the request is subject to the conditions set forth by the mediator and the Consumer Code. Mediation is neither mandatory for the consumer nor does it preclude the consumer’s right to take legal action.
28.3 Jurisdictions
If an amicable settlement cannot be reached, the Consumer may bring the matter before the competent court in accordance with the law, including the court of the Consumer’s place of residence where permitted by law. Any clause designating a different exclusive jurisdiction is unenforceable against the Consumer.
For disputes between businesses, express jurisdiction is granted to the courts within the jurisdiction of DJOBI’s headquarters, including in cases involving multiple defendants or third-party claims, unless otherwise required by mandatory law.
