Special Terms and Conditions of Use and Sale for the DJOBI+ Package

1. Purpose and Acceptance

The DJOBI+ Pack is a subscription that provides access, during its term, to a range of commercial benefits and services described in these Special Terms and Conditions, on the Pack’s overview page, and during the sign-up process.

Before subscribing, the Customer may view, save, and print these Special Terms and Conditions. Confirmation of the subscription and the payment obligation constitutes acceptance of these terms as well as DJOBI’s General Terms and Conditions.

The benefits of the Pack are personal to the subscription holder. Unless expressly authorized by DJOBI, they may not be transferred, resold, shared among multiple Accounts, or used for resale purposes.

2. Eligibility and Enrollment

The DJOBI+ Pack is available to Customers who meet the conditions listed at the time of subscription. Its availability may be limited based on the country of residence, the shipping address, the type of Customer, the applicable Products or Services, and the technical capabilities of the Website.

As of the date of these Special Terms and Conditions, the Package is primarily intended for Customers residing in France or Belgium. Simply accessing the Website from another country does not guarantee that you will be able to subscribe to the Package or enjoy all of its benefits.

The Customer must provide accurate information and use a valid payment method. The subscription is linked to the Account and email address provided at the time of sign-up. Membership in an association, organization, or third-party service does not automatically entitle the Customer to the DJOBI+ Package.

3. Benefits of the DJOBI+ Package

While their subscription is active, members can enjoy the benefits listed on the Pack page, subject to availability, including:

• discounts, offers, or promotional campaigns reserved for members on Products or Services expressly identified as eligible;
• priority handling of certain requests submitted to customer service;
• enhanced support for certain design services or certain Services expressly covered;
• the coverage of certain return shipping costs related to the exercise of a warranty, under the conditions specified in Article 10;
• a return period of up to thirty days for Products listed as eligible.

The description, duration, geographic scope, and terms of use for a discount or benefit included in a specific offer take precedence for that offer. Unless otherwise specified, a discount is not redeemable for cash and cannot be combined with any other offer.

The DJOBI+ Package does not automatically grant a business payment plan with payment due upon maturity. Any such payment plan remains subject to the provisions of the Terms and Conditions, a prior request, and DJOBI’s express acceptance.

4. Limitations and Exclusions

Delivery benefits apply only to orders, Products, amounts, dimensions, weights, destinations, and shipping methods that are indicated as eligible. In particular, the following may be excluded: bulky, heavy, hazardous, or customized Products; Products shipped directly by a partner; Products subject to specific regulations; or Products delivered to an area not covered by the relevant carrier.

The term “express delivery” refers to the use of an expedited shipping method when available; it does not constitute an absolute guarantee of delivery at a specific time. The estimated delivery time begins under the conditions specified at the time of the Order and remains subject to Product availability, preparation, security checks, and events beyond DJOBI’s reasonable control.

The priority assigned to support affects the order in which eligible requests are processed, but does not guarantee an immediate resolution or a fixed timeframe, unless a specific commitment has been communicated in writing. It does not allow for bypassing security, warranty, verification, or anti-fraud procedures.

Benefits may not be used in a fraudulent, automated, or clearly excessive manner. DJOBI may request the information strictly necessary to verify eligibility for use.

5. Price and Payment

As of the date of these Special Terms and Conditions, the retail price of the DJOBI+ Pack is 69.90 euros per year, all taxes included, unless a promotion or a different rate is clearly presented before signing up.

The price, annual billing cycle, trial period, date of the first payment, and renewal terms are summarized before confirmation. Payment and recurring billing are secured by Stripe. DJOBI does not store full credit card information.

The Customer must maintain a valid payment method. If a payment fails, notifications may be sent and additional attempts may be made. If the payment is not settled, the subscription and associated benefits may be suspended or terminated in accordance with the stated terms.

6. Probationary Period

Unless otherwise specified at the time of sign-up, all new subscriptions include a 15-day free trial period. The payment method is saved at the time of sign-up, but the annual fee is not charged until the end of the trial period unless the Customer has canceled before then.

Stripe sends the Customer a reminder before the end of the trial period, provided that the information required to send it has been correctly provided. The Customer may cancel during the trial period through the management portal referred to in Article 8.

DJOBI may limit the free trial to one use per person, account, payment method, or household in order to prevent abuse. The use of a benefit during the trial does not deprive the Consumer of their mandatory rights; the consequences of immediate performance of the Service are governed by Section 9.

7. Term and Renewal

After the trial period, the subscription is valid for one year starting from the date it becomes a paid subscription. It is then automatically renewed for successive one-year periods, unless cancellation is received before the renewal date.

Before each renewal, DJOBI notifies the Consumer via a dedicated email, within the legally required timeframe, of the option to cancel the subscription and the deadline for doing so. This notification is sent no earlier than three months and no later than one month before that deadline.

The Customer remains responsible for ensuring the validity of the email address associated with their subscription. They may view the renewal date and manage their subscription at any time through the portal described in Article 8.

If a notice of mandatory renewal has not been sent in accordance with the law, the consumer has the right to cancel the contract and receive a refund as provided for in the Consumer Code.

8. Online Cancellation

The Customer can manage and cancel their subscription without having to contact DJOBI, through the secure portal accessible at the following address: Manage My DJOBI+ Subscription.

To access the portal, the Customer enters the email address associated with their subscription and follows the provided authentication procedure. In particular, they can view their invoices, update their payment method, and request cancellation.

Unless otherwise provided by law or specified otherwise, cancellation takes effect at the end of the current subscription period. No new annual payment will be charged at that time, and the benefits remain available until that date. Cancellation does not entitle the subscriber to a pro-rated refund for the period already begun, unless required by law, as a goodwill gesture, or due to a failure to perform on the part of DJOBI.

Confirmation of the request and its effective date is provided in a durable medium. The Customer may also contact customer service if they encounter a technical issue; however, this option does not replace direct access to the online cancellation process.

9. Right of Withdrawal

The Consumer has the legal right to cancel the contract within fourteen days of its conclusion, without having to provide a reason for doing so. The Consumer may use the standard form included in the Terms and Conditions or send an unambiguous statement to DJOBI.

If the Consumer requests that the benefits begin to be provided before the end of this period, DJOBI may, in the event of withdrawal, claim only the amount proportional to the Service actually provided up to the time of notification, provided that the legal conditions are met and after prior notice has been given. A single use of a benefit does not, in and of itself, result in the automatic loss of any right to a refund.

The 15-day trial period does not shorten the statutory withdrawal period or replace it.

10. Returns, Warranties, and Related Fees

When members are granted a 30-day commercial return period, the terms of that period are in addition to—and do not reduce—the statutory right of withdrawal. The return period, its start date, excluded Products, expected condition, and applicable procedure are as specified in the offer or the current return policy.

Legal exclusions—including those for certain personalized products, products that have been unsealed for hygiene reasons, perishable items, or certain digital content—remain in effect.

For returns based on a statutory warranty and accepted after inspection, DJOBI will cover the costs for which it is legally responsible. The Package may provide for more favorable commercial coverage for certain warranty returns; in such cases, the shipping terms must be approved in advance by DJOBI. If a shipment is sent on the Customer’s own initiative using an unreasonably expensive method, the Customer may be responsible for the shipping costs to the extent permitted by law.

11. Changes to the DJOBI+ Pack

DJOBI may modify the benefits to improve the Package, take into account the availability of its partners and technical, economic, legal, or logistical constraints, or add new services.

A minor or favorable change may take effect during the current period. Any substantial unfavorable change affecting an essential element, as well as any change in the future price, shall be communicated to the Customer clearly and in a durable medium before it takes effect. The Customer may refuse renewal or terminate the agreement without penalty when permitted by law.

A change shall not retroactively deprive the Customer of a benefit that has been definitively acquired under an Order that has already been placed.

12. Suspension and Termination of Access

DJOBI may suspend all or part of the benefits in the event of nonpayment, fraud, unauthorized sharing, obvious misuse of the benefits, a security breach, or a serious violation of these Special Terms and Conditions.

Unless there is an emergency, fraud, or circumstances beyond DJOBI’s control, the Customer will be notified of the reason and will be given a reasonable period of time to rectify the situation or submit their comments. An unjustified suspension attributable to DJOBI entitles the Customer to the remedies provided by law.

Upon expiration or termination, the benefits shall cease as of the effective date specified. Orders already placed, invoices, warranties, claims, and confidentiality or retention obligations shall continue to be governed by applicable laws.

13. Liability

DJOBI shall perform the Package in accordance with the commitments set forth herein and shall be liable for any breaches thereof under the terms of the law. No provision shall limit statutory warranties, liability for gross negligence or willful misconduct, liability for bodily injury, or any other mandatory right.

DJOBI is not liable for any temporary inability to perform resulting exclusively from the Customer’s fault, an unforeseeable and insurmountable act by a third party, or a force majeure event. A temporary unavailability of the billing portal does not prevent the Customer from contacting DJOBI to protect their rights.

14. Personal Information

The data required for subscription, payment, subscription management, the provision of benefits, fraud prevention, customer support, and compliance with legal obligations is processed in accordance with the Legal Notices and Privacy Policy page.

Stripe processes payment and portal access data in accordance with its own security and privacy commitments. DJOBI does not store full credit card information.

15. Complaints, Mediation, and Disputes

For any issues related to the Pack, the Customer may use the contact bridge or write to contact@djobi.fr. The user provides the email address associated with the subscription and the reason for the request, without submitting complete banking information.

The applicable law, consumer mediation, and competent courts are those set forth in DJOBI’s Terms and Conditions. The Consumer retains the mandatory protections of the country in which he or she habitually resides, to the extent that such protections are granted by law.
