5. Applicable Contractual Documents
Use of the site and purchases are also governed by the Terms and Conditions of Use and Sale, as well as—depending on the service selected—the specific terms and conditions, delivery terms, warranties, and information displayed during the ordering process.
The purpose of this page is to identify the publisher and the web host, to provide information on the general rules for using the site, and to detail the processing of personal data. In the event of a conflict regarding a contractual matter, the document specifically applicable to the transaction in question shall prevail, subject to mandatory legal provisions.
6. Intellectual Property
The structure of the website, DJOBI’s proprietary developments, text, graphics, interfaces, logos, trademarks, visual elements, databases, editorial pages, and content produced by DJOBI are protected by applicable intellectual property rights. Content provided by sellers, manufacturers, partners, or users remains subject to the rights of their respective owners.
Any reproduction, extraction, adaptation, display, distribution, unauthorized automated indexing, or substantial reuse without authorization is prohibited, except as provided by law. Simple links to a public page are permitted provided they do not create any confusion regarding the origin of the content, do not embed the site within a misleading frame, and do not harm the interests of DJOBI or third parties.
Trademarks, visuals, and product features are the property of their respective owners. Photographs and renderings are provided for illustrative purposes only; the contractual information applicable to the product is as confirmed in the product description and the order, subject to consumer rights.
7. Content Posted by Users and Sellers
Users and sellers remain responsible for the content they transmit or publish: reviews, profiles, listings, descriptions, messages, attachments, images, and business documents. They must have the necessary rights and authorizations and must not transmit content that is illegal, misleading, infringing, malicious, or that infringes on the rights of others.
DJOBI may moderate, hide, or remove content that is clearly illegal, violates its rules, or must be removed to ensure the security of the service. Problematic content or behavior can be reported to customer service along with information that identifies it.
8. Availability, Security, and Liability
DJOBI takes reasonable measures to ensure the accessibility and security of the website. However, continuous availability cannot be guaranteed, particularly in the event of maintenance, updates, technical incidents, service provider outages, cyberattacks, external events, or force majeure.
The information is carefully updated. However, factual errors, synchronization delays, out-of-stock items, or changes made by a supplier may occur. Applicable prices, inventory levels, delivery times, and product specifications are confirmed during the ordering process.
Links to third-party services are provided for your convenience. DJOBI does not continuously monitor their content, availability, or practices. Users remain responsible for the security of their devices, the confidentiality of their login credentials, and the use of their accounts.
9. Data Controller and Relevant Data
For data processing operations for which it determines the purposes and means, DJOBI SASU acts as the data controller.
When a product or service is sold by a third-party seller, that seller receives the information necessary to fulfill the order, provide after-sales service, and generate the associated receipt. The seller may not use this information for any other purpose without having its own legal basis and without providing the required information.
19. Durées de conservation
DJOBI does not retain data indefinitely. The retention period depends on the purpose of the data, account activity, warranty or statute of limitations periods, accounting and tax obligations, the need to secure the service, and the existence of a legal dispute. Data may be transferred from an active database to a restricted-access archive prior to its deletion or anonymization.
| Data | Duration or primary criterion |
|---|---|
| Customer Account and Profile | During the active relationship, and subsequently during the period required to manage an inactive account, warranties, claims, and rights. Data with no legal purpose is then deleted or anonymized. |
| Orders, invoices, and accounting documents | Ten years from the end of the fiscal year or from the date of issuance of the instrument, when such period is required by accounting and commercial regulations. |
| Transaction Data | Time required for payment, refunds, dispute resolution, and compliance with the payment service provider’s obligations. DJOBI does not store the full card number. |
| Shipping and Tracking | Duration of performance, followed by the time required for claims, warranties, evidence, and applicable obligations. |
| Tickets et messages de support | During the processing of the request, and thereafter for as long as necessary to manage the relationship, retain evidence, and handle any disputes. Attachments permitted in service tickets are deleted when the ticket is closed, resolved, or deleted, unless retention is required by a legal obligation or a dispute. |
| Seller and Partner Profiles | During the course of the relationship, and thereafter for the applicable legal, accounting, tax, warranty, and statute of limitations periods. |
| Sales Prospecting | For a customer, during the business relationship and for up to three years after its termination or the last relevant contact; for a prospect, for up to three years after the data was collected or the last contact initiated by the prospect, unless the customer has previously withdrawn consent or objected. |
| Proof of an objection or a withdrawal | Retain the minimum amount of information necessary to ensure that the individual's choice is respected over the long term and to avoid unnecessarily contacting the individual again. |
| Technical and Safety Journals | Retention period commensurate with the detection and investigation of incidents and the protection of the service, followed by deletion or anonymization, unless necessary for evidentiary purposes. |
| Cookies and Tracking Identifiers | The retention period is determined based on the purpose of the data and is specified in the management system or by the provider. The choice to consent or refuse is retained for a reasonable period of time and may be renewed periodically. |
| Backups | According to a limited rotation cycle. Data deleted from the active database may remain temporarily in a secure backup until it is overwritten, without being reused for any other purpose. |
In the event of a legal dispute, suspected fraud, a subpoena, or a legal obligation, only the relevant data may be isolated and retained until the applicable time limit expires or the proceedings are definitively closed.
21. Vos droits et leur exercice
In accordance with the legal basis and the conditions set forth in the regulations, you have the following rights:
- the right to access your data and obtain a copy;
- the right to correct inaccurate or incomplete data;
- the right to erasure, when there is no legal obligation or legitimate reason to retain the data;
- right to restriction of processing;
- the right to object to processing based on legitimate interests, in particular for marketing purposes;
- the right to withdraw your consent at any time, without affecting the lawfulness of processing that took place prior to the withdrawal;
- the right to data portability when automated processing is based on consent or a contract;
- the right to establish guidelines regarding what happens to your data after your death, in accordance with French law;
- the right not to be subject to a decision that produces legal effects based solely on automated processing, where applicable.
To exercise a right, please write to dpo@djobi.fr or to DJOBI SASU, 11 rue de Narvik, 38290 La Verpillière, France. Please specify the right you are requesting, provide information to identify the account or transaction in question, and include a return address.
Proof of identity is requested only if there is reasonable doubt regarding the applicant’s identity. Only the information strictly necessary for this verification should be provided; it is protected and deleted when it is no longer needed.
DJOBI generally responds within one month. This period may be extended by two months if the request is complex or involves a large number of requests; in such cases, the individual will be notified within the first month. Certain requests may be restricted or denied if they conflict with a legal obligation, the rights of a third party, security, freedom of expression, or another reason provided for by regulation.
You can file a complaint with the National Commission for Information Technology and Civil Liberties (CNIL) : www.cnil.fr, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07.
22. Informations propres à certains services
22.1 Connexion Google
When selected, the Google connection sends DJOBI the information needed to create or link the account, such as a technical identifier, an email address, and authorized profile information. DJOBI does not receive the Google password. The user can manage permissions from their Google account.
22.2 Paiement
The payment form may be hosted or secured by Mollie or by the institution associated with the selected payment method. This service provider processes financial data in accordance with its own obligations and provides DJOBI with the information necessary to confirm, refund, or dispute the transaction.
22.3 Assistance et pièces jointes
Standard support tickets do not necessarily allow for the submission of files. For purchased services, a private ticket may be created automatically and linked to the customer, the seller, and the order. When attachments are permitted, they are accessible only to those authorized to handle that ticket. Users should only send files that are relevant, lawful, and free of excessive data.
22.4 Vendeurs
Public information from a seller’s store is visible to visitors according to the platform’s settings. Verification documents, personal contact information, sales data, and payment information are not public. Customers should receive only the information necessary for their purchase and for exercising their rights.
22.5 Flux produits, moteurs et Discord
DJOBI generates product feeds, metadata, sitemaps, and indexing signals to list its catalog with search engines and platforms. A system can also post batches of new products on Discord using public information from the catalog. These posts are not intended to include customers’ personal data.
22.6 Traduction
Certain content may be submitted to a translation service such as DeepL. DJOBI strives to limit this use to editorial or commercial content that does not contain unnecessary personal data.
23. Mineurs et capacité juridique
DJOBI’s commercial services are intended for individuals who have the necessary legal capacity or who are acting with the authorization of their legal representative. DJOBI does not knowingly seek to collect data from minors without a valid basis. A legal representative may contact DJOBI with any questions regarding a minor’s data.
24. Sécurité, confidentialité et violations de données
DJOBI implements technical and organizational measures appropriate to the risks involved: HTTPS encryption, access controls, separation of duties, updates, backups, security logs, attachment limits, protection against spam and fraud, monitoring, and recovery procedures.
No measure can completely eliminate the risk. In the event of a data breach that could pose a risk to individuals, DJOBI documents the incident and notifies the CNIL in accordance with regulatory requirements and deadlines. When the risk is high, the affected individuals are also notified, unless otherwise required by law.
Any incident or suspicious message can be reported immediately to contact@djobi.fr. Never provide your password or your full credit card number in a ticket or via email.
25. Évolution de la présente politique
DJOBI may update this page to reflect legal, technical, commercial, or organizational changes. The date at the top of the page identifies the current version. In the event of a substantial change affecting rights or purposes, additional information may be posted on the website or sent by an appropriate means.
26. Droit applicable et règlement des différends
This website and this page are governed by French law and applicable European Union law. The rules regarding orders, the right of withdrawal, warranties, consumer mediation, and competent courts are set forth in the Terms and Conditions of Use and Sale.
Before taking any legal action, the user is encouraged to contact DJOBI to seek an amicable resolution; however, this encouragement does not limit the user’s right to bring the matter before an authority, a mediator, or a competent court.
